Terms of Use
xoNation.ai is an online chat service. The terms “you” and “user” refer to anyone who visits or uses the Site.
These Terms of Service (the “Agreement”) and the Privacy Policy, both available at http://www.xonation.ai and updated periodically, govern your use of the Site and Service. They apply alongside any separate agreements between you (or your employer) and xoNation.ai concerning the System (for example, an Enterprise Agreement).
You must regularly review these terms to stay informed of updates.
By using the Site or selecting “Start my free trial!”, you acknowledge and agree to this Agreement and the Privacy Policy.
If you are under 18, lack authority to bind a third party, are restricted by U.S. sanctions, or disagree with any term herein, you must discontinue use immediately.
xoNation.ai may update, modify, or discontinue any aspect of the Site, Service, Agreement, or Privacy Policy at any time. Updates to content or functionality take effect immediately; updates to terms become effective upon posting. Continued use after changes constitutes acceptance.
xonation.ai may restrict, suspend, or terminate access to the Site or Service at any time, with or without notice. Any new features or updates will also fall under this Agreement and the Privacy Policy.
Unless covered by an Enterprise Agreement, the Service is intended for personal use only and requires account registration.
You may not use the Site or Service unlawfully or in any way that disrupts its operation. The Service is provided “as is” and “as available.” xoNation.ai makes no promises of specific results, and any outputs generated may be inaccurate or fictional.
While you retain ownership of your output, you use it at your own risk. You must provide accurate registration details. xoNation.ai may deny or cancel registration without notice.
By using the Service, you affirm that:
You release xoNation.ai and its affiliates from all liability arising from your use of the Service.
You are solely responsible for your account, credentials, and all activity associated with it.
You must not share access, upload unlawful or offensive material, or engage in harassment, fraud, spam, or objectionable behavior.
Violations may result in immediate account termination. xoNation.ai may investigate your use to enforce compliance or assist with legal inquiries.
Only humans may use the Service; automation is forbidden. You may not alter or falsely associate other websites with xoNation.ai.
The Service is not intended for data storage or backup. Any use not explicitly authorized by this Agreement is prohibited.
All rights to the Site, Service, and associated intellectual property (“xoNation.ai’s IP”) are owned or licensed by xoNation.ai. This includes all content, design, code, and trademarks.
By submitting information (“Input”) or receiving results (“Output”), you grant xoNation.ai a perpetual, worldwide, royalty-free license to use such data as needed to operate, improve, and maintain the Service, fulfill legal obligations, and conduct business operations.
You warrant that you have all necessary permissions for the Input provided.
The Site may contain links or advertisements related to third-party sites, products, or services. These are provided for convenience only and are used at your own risk.
xoNation.ai is not responsible for third-party content, privacy practices, or resulting losses.
xoNation.ai implements reasonable safeguards to protect data integrity and security. However, data transmitted through the Service may travel unencrypted across various networks.
You should avoid submitting personally identifiable information. If you are subject to GDPR, you consent to xoNation.ai’s processing of your data in line with this Agreement.
You are responsible for ensuring GDPR and other applicable data protection compliance when providing personal data through the Service. These obligations survive termination.
If you submit ideas, feedback, or creative materials (“Ideas”) to xoNation.ai, you do so voluntarily, without expectation of payment or confidentiality.
By submitting, you irrevocably assign all rights, titles, and interests—including intellectual property—to xoNation.ai. Do not submit Ideas if you expect compensation or wish to retain ownership.
You agree to defend and indemnify xoNation.ai and its affiliates from all claims, losses, or expenses arising from your use of the Site, Service, or Output, your account activities, or violations of law or this Agreement.
xoNation.ai may assume defense at your expense. This obligation survives account termination.
xoNation.ai may assign this Agreement freely. You may not transfer or delegate your rights or duties without xoNation.ai’s prior written consent.
xoNation.ai offers free trials and paid subscription plans.
Your payment method will be charged automatically at the start of each subscription term unless cancelled before renewal.
No refunds or credits are issued for partial months or unused services.
All fees are in U.S. dollars and must be paid accordingly, inclusive of applicable taxes.
Nonpayment may result in suspension, termination, and additional fees (including late fees, interest, and collection costs).
You authorize xoNation.ai to charge your designated payment method for all amounts due.
All payments are non-refundable unless otherwise stated by xoNation.ai.
You may cancel your account at any time through your account settings.
Upon cancellation, all account data will be permanently deleted and cannot be recovered.
You remain responsible for any unpaid charges incurred prior to termination.
THE SYSTEM AND OUTPUT ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.”
XONATION.AI DISCLAIMS ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You use the Service, your data, and any outputs entirely at your own risk. xoNation.ai does not warrant uninterrupted or error-free operation.
To the fullest extent permitted by law, neither party shall be liable for indirect, incidental, or consequential damages, including lost profits or goodwill.
xoNation.ai’s total cumulative liability shall not exceed $100.
These limitations do not apply to indemnification obligations or intellectual property violations.
xoNation.ai may modify the Service or its fees at any time. Any fee changes take effect at the next renewal period.
This Agreement is governed by the laws of Maryland, excluding conflict-of-law principles.
All disputes shall be resolved in the courts of Baltimore, Maryland, and you consent to their jurisdiction.
Unresolved disputes will first be mediated, then arbitrated under the American Arbitration Association (AAA) Commercial Rules.
Arbitration shall occur in Baltimore, Maryland, before a single experienced arbitrator.
Awards are limited to monetary damages, and the prevailing party may recover reasonable legal fees.
All proceedings are confidential unless disclosure is required by law.
If you have a problem, please talk to us. Any dispute with us must be resolved in Los Angeles under California law.
You acknowledge that breaches of Sections 4–7 or 9 may cause irreparable harm. xo Nation.ai may seek injunctive relief in Maryland courts without posting bond or proving damages.
